Latest Story

The AgustaWestland chopper scam timeline starts with a 1999 plan to replace the Indian Air Force’s VVIP helicopters and a contract signed on 8 February 2010 for 12 AW101s worth €556.262 million, or Rs 3,726.96 crore. In February 2013 Italy arrested the head of AgustaWestland’s parent group, India asked the CBI to investigate, and on 1 January 2014 the contract was terminated. The CAG found that the procurement deviated from procedure, including a cut in the altitude requirement that made the AW101 eligible. In Italy, the executives were finally acquitted of corruption in 2019. In India, the CBI and ED have filed charge sheets against a former Air Chief, a former Defence Secretary and alleged middlemen, but no trial had reached a verdict by October 2026, and the alleged middleman Christian Michel James was still fighting for release in the Supreme Court. This page keeps the allegations, the audit findings and the court orders apart.

💡 Short Answer

India signed for 12 AgustaWestland AW101 VVIP helicopters on 8 February 2010 for Rs 3,726.96 crore and terminated the contract on 1 January 2014 after bribery allegations surfaced in Italy. The CAG criticised the procurement process. Italy’s courts acquitted the company executives in 2018-19. In India, the CBI and ED cases against former IAF chief S.P. Tyagi, alleged middleman Christian Michel James and others were still pending in October 2026; charges had not been framed in the CBI case.

AgustaWestland Case: Key Questions

What is the AgustaWestland scam?
Allegations that commissions paid through middlemen on India’s 2010 contract for 12 AW101 VVIP helicopters were bribes. The CBI and ED are prosecuting; the accused deny it. The contract was terminated in 2014.
What did the CAG find?
That the process deviated from procedure: the altitude requirement fell from 6,000 m to 4,500 m, trials were held abroad and the price benchmark left no room to negotiate. It did not find bribery.
Has anyone been convicted?
Not in India, as of October 2026. In Italy, the former Finmeccanica and AgustaWestland chiefs were acquitted of corruption, with the verdict made final in May 2019.
Where is Christian Michel now?
Latest reports describe him as in custody despite bail in both cases. His petition challenging the India-UAE extradition treaty and seeking release was pending in the Supreme Court.

Supreme Court petition still pending; Michel back before the trial court Unresolved

25 Aug 2026 listing3 Sep 2026 Rouse Avenue appearanceOutcome of the listing not found

After the 24 July order, Michel’s petition was listed for 25 August 2026. AiTimeline found no report of what happened at that hearing, whether the Centre filed its counter-affidavit, or any ruling. On 3 September 2026 IANS photographed him arriving at the Rouse Avenue court in New Delhi, where both the CBI and ED cases are tried (IANS via SocialNews.xyz).

As of the latest reports found, he had bail in both cases but remained in custody, and the court had noted in December 2025 that charges were not yet framed in the CBI case.

Why it matters: Nearly eight years after his extradition, the trial of the man the CBI calls the middleman has not reached the charge stage.

Supreme Court gives the Centre a last three weeks to reply Court order

24 Jul 2026Justices Vikram Nath and Sandeep MehtaSLP (Crl) 7103/2026

The bench gave the Union government a final three weeks to file its counter-affidavit and said no more time would be given, listing the case for 25 August (ANI). Michel argues that he has already served more than the seven-year maximum for the offences on which the UAE extradited him, so continued detention breaches Article 21.

Why it matters: The government had not answered the petition three months after notice.

Supreme Court issues notice on the extradition-treaty challenge Court order

24 Apr 2026 (LiveLaw)4 May 2026 notice to Centre, CBI, EDNot a ruling

LiveLaw reported on 24 April 2026 that a bench led by Chief Justice Surya Kant issued notice on Michel’s challenge to Article 17 of the 1999 India-UAE extradition treaty, which allows prosecution for offences connected with those in the extradition request (LiveLaw). On 4 May a bench of Justices Vikram Nath and Sandeep Mehta issued notice to the Centre, CBI and ED, returnable in four weeks (LiveLaw). He argues the clause conflicts with the rule of speciality in Section 21 of the Extradition Act.

Why it matters: Notice means the court will hear the challenge, not that it accepted it or ordered his release.

Delhi High Court refuses to free Michel Court order

8 Apr 2026Justices Navin Chawla and Ravinder Dudeja2026 LiveLaw (Del) 354

The division bench dismissed his petition and upheld the trial court’s refusal to release him under Section 436A CrPC. It held there was no conflict between Section 21 of the Extradition Act and Article 17, because the Dubai extradition decree covered offences “directly arising from the factual background” (LiveLaw). The forgery charge under Section 467 IPC carries a possible life term, so he could not be said to have served the maximum sentence.

Why it matters: This is the order now under challenge in the Supreme Court.

Release ordered in the ED case; bail terms eased in the CBI case Court order

20 Dec 2025 (ED case)23 Dec 2025 (CBI case, Special Judge Sanjay Jindal)Still in custody

On 20 December a Rouse Avenue court ordered Michel’s release in the ED money-laundering case, accepting that he had spent about seven years in custody, the maximum under the money-laundering law (National Herald). He stayed in jail because of the CBI case. On 23 December Special CBI Judge Sanjay Jindal allowed a cash surety in place of a fixed deposit and dropped the passport deposit for now, because his passport had expired; the FRRO was told to stop him leaving India. The judge noted that “charges are yet to be decided” (LawBeat).

Why it matters: Easier bail terms are not release; later reports still described him as in custody.

Trial court refuses release on time served in the CBI case Court order

7 Aug 2025Special Judge (PC Act) Sanjay JindalSection 436A CrPC

Michel said he had served the seven-year maximum for the extradited offences. The court disagreed because the CBI also accuses him of forgery under Section 467 IPC, punishable with life imprisonment, and said whether that charge holds will be decided at the charge stage (ETV Bharat).

Why it matters: The forgery count is the hinge of every later custody ruling.

4 Mar 2025Delhi High CourtMoney-laundering case

The High Court granted Michel bail in the Enforcement Directorate’s money-laundering case, two weeks after the Supreme Court’s bail order in the CBI case (India Today). The ED’s 2016 prosecution complaint alleges he received about €30 million from AgustaWestland.

Why it matters: Bail in both cases did not get him out, because the conditions were not met.

Supreme Court grants bail in the CBI case Court order

18 Feb 2025Supreme Court of IndiaBail, not acquittal

The Supreme Court granted Michel bail in the CBI corruption case, citing more than six years in custody and the slow pace of the trial (Indian Express). He remained in Tihar because he could not satisfy the conditions, including furnishing a local address with an expired passport.

Why it matters: A bail order says nothing about whether the allegations are true.

Dubai-based businessman Rajiv Saxena and corporate lobbyist Deepak Talwar were brought from the UAE in the early hours of 31 January (Madhyamam/PTI). In March a Delhi court allowed Saxena to become an approver in the ED case, with the agency’s support (Bar and Bench). The ED alleges he helped build the corporate structure used to move money.

Why it matters: An approver’s account is evidence the court still has to weigh.

On 22 May 2019 Italy’s top court upheld the acquittals (ANSA). The CBI said the Italian verdict had no bearing on its case, which rests on its own investigation (Business Standard/PTI).

Why it matters: The country where the bribery case began ended with no corruption conviction of the executives.

The CBI’s first charge sheet named former Air Chief Marshal S.P. Tyagi and others, alleging a conspiracy to change the helicopter requirements in return for money routed through middlemen (Wikipedia summary). Tyagi denies the charges.

Why it matters: The core allegation links the altitude change to payments, which the CBI must prove.

In April 2016 the Milan appeals court sentenced Orsi to four and a half years and Spagnolini to four for international corruption, and its reasoning was widely quoted in India. On 16 December Italy’s Court of Cassation annulled that verdict for procedural errors and ordered a retrial (The Quint).

Why it matters: The Indian debate leaned on a judgment that no longer stands.

ED files its money-laundering complaint against Michel Allegation

Jun 2016Enforcement DirectorateAlleged €30 million

The ED’s prosecution complaint alleges Michel received about €30 million from AgustaWestland through contracts it says disguised commissions (LiveLaw).

CAG report questions the procurement Audit finding

13 Aug 2013Report No. 10 of 2013Union Defence compliance audit

The auditor found the process deviated from procedure: the altitude requirement was cut from 6,000 m to 4,500 m and a 1.8 m cabin height added, which made the AW101 eligible and the Eurocopter EC225 ineligible; field trials required in India were held abroad on a representative helicopter; and the benchmark price left “no room for negotiation” (CAG; PRS summary).

Why it matters: An audit can show procedural lapses without proving that anyone was bribed.
Two bars: 2002 tender service ceiling 6,000 metres, met only by the Eurocopter EC225; 2006 tender 4,500 metres plus 1.8 metre cabin height, which made the AW101 eligible and the EC225 ineligible

The revised request for proposals used the lowered 4,500 m ceiling and the new cabin-height rule. Field evaluation of the AW101 was done abroad on representative aircraft while the version offered was still in development, which the CAG later criticised (PRS summary).

Why it matters: These are the procedural choices at the centre of the CAG’s objections.

200211 vendorsCancelled for a single-vendor situation

The first RFP required operation at 6,000 m. Only the Eurocopter EC225 met it, so the process was scrapped as a single-vendor situation (PRS summary).

IAF proposes replacing its VVIP helicopters Established

1999Indian Air ForceMi-8 fleet

The IAF proposed replacing its ageing VVIP helicopters with a more capable type, beginning a procurement that took more than ten years (PRS summary).

Why it matters: The decade-long acquisition itself left the IAF’s problem unsolved.

People Also Ask

Who was the middleman in the AgustaWestland deal?
The CBI and ED name British national Christian Michel James as an alleged middleman, along with others named in the charge sheets. These are allegations; Michel denies wrongdoing and no court has convicted him.
Why is it called the VVIP chopper scam?
Because the 12 helicopters were meant to carry the President, Prime Minister and other protected dignitaries. Scam is the popular label for the bribery allegations, not a court finding.
Did the Supreme Court release Christian Michel?
No. It granted him bail in the CBI case in February 2025 and in 2026 issued notice on his petition for release. AiTimeline found no order releasing him as of October 2026.
Was the AgustaWestland contract cancelled or terminated?
Terminated, on 1 January 2014, under the contract’s integrity-pact terms. That allowed India to encash bank guarantees while keeping the three helicopters already delivered.
What is Article 17 of the India-UAE extradition treaty?
A clause allowing the requesting country to prosecute an extradited person for offences connected with those for which extradition was granted. Michel says it conflicts with Indian law on speciality; the Delhi High Court disagreed.

Frequently Asked Questions

What is the AgustaWestland VVIP chopper case?
It concerns India’s 2010 contract for 12 AW101 helicopters for VVIP transport. Italian and Indian investigators examined allegations that commissions paid through middlemen were bribes to influence the deal. The CAG separately criticised the procurement. In India the CBI and ED cases were still before the courts in October 2026.
How much was the AgustaWestland helicopter contract worth?
About 556.262 million euros, which the CAG converted to Rs 3,726.96 crore. The figure of Rs 3,600 crore often used in news reports is a rounded number.
When was the AgustaWestland contract signed?
On 8 February 2010, between the Ministry of Defence and AgustaWestland International Ltd of the UK, for 12 AW101 helicopters.
Why did India cancel the AgustaWestland deal?
The Defence Ministry terminated it on 1 January 2014, citing breach of the pre-contract integrity pact and the agreement after the bribery allegations surfaced. Termination is a contractual decision, not a criminal finding.
How many AgustaWestland helicopters did India receive?
Three of the twelve had been delivered before the contract was terminated. Reports in 2018 described them as parked unused in IAF hangars.
Did India get its money back?
India encashed bank guarantees, and the total recovered was reported at about Rs 2,068 crore by mid-2014, against roughly Rs 1,620 crore paid. Reported figures vary with date and source.
What did the CAG say about the AgustaWestland deal?
The CAG’s 2013 report said the process deviated from procedure. The altitude requirement was cut from 6,000 m to 4,500 m and a cabin-height rule added, field trials were held abroad, and the price benchmark left no room to negotiate. It did not find that anyone took a bribe.
Why does the altitude change matter?
The 2002 tender’s 6,000 m ceiling was met only by the Eurocopter EC225. The 2006 tender’s 4,500 m ceiling and 1.8 m cabin height made the AW101 eligible. The CBI alleges the change was part of a conspiracy; the accused deny it.
Who is Christian Michel James?
A British national whom the CBI describes as a middleman in the deal. He was extradited from the UAE in December 2018 and is an accused in both the CBI and ED cases. He denies wrongdoing.
Is Christian Michel still in jail?
As of the latest reports found, yes. He received bail in 2025 in both cases, and a court ordered his release in the ED case in December 2025, but he remained in custody in the CBI case. His Supreme Court petition for release was pending.
What is Christian Michel’s Supreme Court petition about?
He challenges Article 17 of the 1999 India-UAE extradition treaty, which allows prosecution for connected offences, and says he has already served the seven-year maximum for the offences on which he was extradited. The Supreme Court issued notice in April and May 2026.
Why did the courts refuse to release Michel for time served?
Because the CBI also accuses him of forgery under Section 467 IPC, which carries a possible life sentence. The trial court in August 2025 and the Delhi High Court on 8 April 2026 said he could not be treated as having served the maximum.
Was former IAF chief S.P. Tyagi convicted?
No conviction has been reported. He was arrested on 9 December 2016, granted bail on 26 December 2016, and named in the CBI’s September 2017 charge sheet. He denies the charges, and the trial has not concluded.
Who is Shashi Kant Sharma in the AgustaWestland case?
A former Defence Secretary, later Comptroller and Auditor General, whom the CBI named in a March 2022 charge sheet after the government granted sanction. A charge sheet is an allegation, not a verdict.
What happened in the Italian courts?
A trial court in 2014 acquitted former Finmeccanica chief Giuseppe Orsi and former AgustaWestland CEO Bruno Spagnolini of corruption. An appeals court convicted them in April 2016, but that verdict was annulled. A retrial acquitted them in January 2018, and Italy’s top court upheld that in May 2019.
Does the Italian acquittal end the Indian case?
No. The CBI has said the Italian verdict has no bearing on its case, which rests on its own investigation. The Indian cases continue separately.
Who is Rajiv Saxena?
A Dubai-based businessman extradited from the UAE on 31 January 2019. A Delhi court let him become an approver in the ED case in March 2019. The ED alleges he helped set up the corporate structure used to move funds.
What is the difference between the CBI and ED cases?
The CBI case covers alleged bribery, cheating, conspiracy and forgery in the deal. The ED case covers alleged money laundering of the proceeds. They have different accused lists, bail orders and maximum sentences.
Has anyone been convicted in India in the AgustaWestland case?
No conviction in the main Indian cases had been reported by October 2026. In December 2025 the trial court noted that charges had not yet been framed in the CBI case.
When did the CBI register the AgustaWestland FIR?
In March 2013, after a preliminary enquiry registered on 25 February 2013. The Solicitor General gave 12 March as the date; other accounts say 13 March. It named 13 persons and four companies.
What triggered the Indian investigation?
The arrest of Finmeccanica chief Giuseppe Orsi in Italy on 12 February 2013. The same day the Defence Ministry asked the CBI to inquire and froze payments.
What did the Supreme Court decide in February 2025?
On 18 February 2025 it granted Michel bail in the CBI case, citing prolonged custody and trial delay. It was a bail order, not an acquittal.
What happened in December 2025?
On 20 December a Rouse Avenue court ordered Michel’s release in the ED case for time served. On 23 December the CBI court eased his bail conditions, allowing a cash surety and waiving the passport deposit for now. He was still described as in custody afterwards.
What was the latest development by October 2026?
On 24 July 2026 the Supreme Court gave the Centre a final three weeks to reply to Michel’s petition and listed it for 25 August. AiTimeline found no report of a ruling after that date. He appeared at the Rouse Avenue court on 3 September 2026.
Which helicopter did India buy?
The AgustaWestland AW101, a three-engine medium-lift helicopter, in a VVIP configuration. AgustaWestland was then part of Finmeccanica, now Leonardo.
Is the AgustaWestland case the same as Bofors?
No. Bofors concerned 1986 artillery guns; AgustaWestland concerns 2010 helicopters. Both are defence deals in which allegations of kickbacks through middlemen led to long investigations with few or no convictions.

Three Records That Should Not Be Merged

The AgustaWestland case is three different records. The CAG’s audit established that the procurement departed from procedure. The CBI and ED charge sheets allege that the departure was bought, through middlemen and disguised commissions. The courts have so far ruled only on custody, bail and extradition in India, and on the executives’ guilt in Italy, where they were acquitted. Thirteen years after the FIR, the question at the centre of the Indian case, whether anyone was bribed, has not been put to a trial. For the same pattern in an older defence deal, see AiTimeline’s Bofors scandal timeline; for other cases, the India political cases tracker.

⚠️ Editorial Note

Last updated 25 October 2026. This timeline separates audit findings, investigating-agency allegations and court orders. No person named here has been convicted in India; charge sheets and prosecution complaints set out the agencies’ case, which the accused deny. Corrections to the source brief: the brief did not mention the Italian acquittals (final in May 2019), the 20 December 2025 order releasing Michel in the ED case, the 8 April 2026 High Court date, the 24 July 2026 Supreme Court order, or the March 2022 charge sheet’s naming of former Defence Secretary Shashi Kant Sharma. The FIR is dated 12 March 2013 by the Solicitor General and 13 March in other accounts. Recovery figures come from press reports and vary. The outcome of the 25 August 2026 Supreme Court listing could not be found; the latest report found is Michel’s court appearance on 3 September 2026. The PIB release of 22 July 2014 could not be opened (HTTP 403). The photograph shows an AW101 of the Polish Navy, the same type India ordered, not one of India’s helicopters. Suggested internal links in the brief (a CAG controversies list, a procurement policy timeline, a CBI vs ED explainer and a Michel case page) do not exist on AiTimeline, so related published case timelines are linked instead.
